Al-Mezan Center for Human Rights strongly condemned the continued imposition of a strict siege by the Israeli occupation forces on the Gaza Strip for the fifteenth year in a row and the imposition of strict restrictions on freedom of movement and movement, especially for the purpose of treatment, which caused the death of the child Farouk Muhammad Ismail. Abu Naga, 6, due to the delay in granting him a permit to pass through the Beit Hanoun (Erez) checkpoint, to reach Hadassah Hospital, Ein Kerem, for treatment.
According to the information available to the center in his capacity as the child´s legal agent, Farouk suffered from “neural atrophy” in the brain, and due to the lack of necessary treatment in hospitals in the Gaza Strip, he received a special medical referral for treatment at Hadassah Ein Kerem Hospital in Jerusalem, and got an appointment From the hospital on January 12, 2022, his request remained under study with the occupation authorities and he was unable to travel. On August 10, 2022, he obtained another appointment. In addition to the center´s legal interventions, his request also remained under study until he died on August 25, 2022.
The Center indicated that since the beginning of this year, four patients, including three children, have died because they were not granted the necessary permits for treatment in hospitals outside the Gaza Strip by the occupation forces.
Al Mezan Center for Human Rights held the occupation authorities fully responsible for the death of the child Abu Naga, as a contracting party to the Fourth Geneva Convention of 1949, which obligates the occupying power to secure health care for the residents of the occupied territories, and a party to the International Covenant on Economic, Social and Cultural Rights, especially Article (12) of it affirming the human right to the enjoyment of the highest attainable standard of physical and mental health, and a party to the International Convention on the Child , which affirmed in Article 24 (1), (States Parties recognizing the right of the child to the enjoyment of the highest attainable standard of health and his right to facilities for the treatment of diseases and health rehabilitation,and States Parties shall make every effort to ensure that no child is deprived of his right to access these health care services).
PCHR called on the international community to assume their legal responsibilities towards the residents of the occupied Palestinian territory, and to oblige the occupying power to respect the provisions of international law, end the siege of Gaza and stop its continuous violations of the rights of Palestinian patients and enable them to access hospitals and receive appropriate treatment without any restrictions.
PCHR reaffirmed that the continuation of and impunity constituted an encouraging factor for the continuation and escalation of immunity by the occupation authorities of the rules of international law in their dealings with the Palestinians in the occupied territories.
